Brand cybersquatting case

Brand cybersquatting case

Lenovo’s experience is undoubtedly thought-provoking. On April 28, 2003, Lenovo Group changed its long-standing logo from “legend” to “lenovo.” Why did it abandon the old brand worth 20 billion yuan and spend a lot of money to create a new brand? In fact, when Lenovo started using the “legend” trademark in 1988, it knew that “legend” had been registered by many foreign companies. When it began to enter overseas markets on a large scale, it conducted an international search for trademarks and found that there were "legend" trademarks in many countries in the world, and some trademarks existed even before Lenovo was established. In this case, the cost of negotiation, repurchase, and legal settlement would be too high. To meet the needs of its internationalization strategy, Lenovo resolutely launched a new trademark.

In January 2006, in a routine announcement made by the Spanish government's trademark registration department, Galanz’s European sales company discovered that the trademark “Galanz” had been registered. After several twists and turns, I just applied to the Spanish trademark registration department to revoke this maliciously registered trademark. Two months later, Galanz found again that the cybersquatter had preemptively registered the "Galanz" trademark with the European Union Trademark Office, and it has successfully entered the three-month publicity period. According to relevant regulations, if Galanz failed to apply for cancellation of cybersquatting within the three-month publicity period with sufficient reasons, then it would no longer be able to sell products under the "Galanz" trademark in EU countries. This was self-evident for Galanz, which accounts for nearly half of the global microwave oven market.

On March 6, 2005, China Hisense Group and German Bosch-Siemens Home Appliances Group (Bossie Home Appliances) reached a settlement agreement in Beijing on the existing trademark disputes between the two parties after full negotiation: Bossie Home Appliances agreed to transfer the “HiSense” trademark registered in Germany and the European Union and other regions to Hisense Group based on the local laws. At the same time, the trademark litigation against Hisense was cancelled. Hisense Group also cancelled all trademark registration applications against Bossie Appliances.

Shanghai “Hero Brand” gold pen is very popular among Japanese consumers, but its trademark was registered in Japan by Japanese merchants, which required us to pay him a 5% commission based on the sales volume of "Hero Brand" gold pen in Japan. As a result, our affiliates in Japan stopped selling on their behalf because they were unprofitable, and we paid a huge price for this.

In the 1980s, the former Tianjin Goubuli Baozi Catering Group Co., Ltd. cooperated with Daiei Co., Ltd. and opened a Tianjin “Goubuli” branch in Japan. Daiei Co., Ltd. took advantage of the fact that the trademark "Goubuli" was not registered in Japan, and in 1993 registered the trademark "Goubuli" in the 43rd category in Japan under its own name. This trademark is valid until July 31, 2005. Afterwards, "Goubuli" claimed its own trademark, but at this time, the trademark "Goubuli" was registered in the United States, involving goods and services.
